Speed stop becomes DUI stop

May 8, 2007, 3:11 AM
An officer monitoring traffic speed with a radar gun stopped a speeding red 2002 Jeep in the 2800 block of Harlem. The driver, Chicagoan Rene Rabiela, 42, stumbled out of the car, upon which the officer told him to sit back down inside it.  Rabiela tried to hand his keys to the officer, saying, “you’re in charge, you’re in charge” in a slurred voice.  His eyes were glazed and bloodshot, and he could not concentrate on the questions the officer asked him. In addition, he gave off a strong odor of alcohol.  Rabiela told the officer he had been at a party, had only a few beers, and repeatedly said “you’re in charge.” He failed three field sobriety tests.  On the ride to the station house, Rabiela more than once told the officer he could get him front row seats at any concert and stated he knew a lot of “big people” downtown.  The officer advised him against making any such offers.  Once at the station, the driver did not follow instructions correctly to get a proper breath-test result.  He grew uncooperative and refused to sign the paper stating he had been read his Miranda warning.  Rabiela was ticketed for DUI, speeding and improper lane usage.
