Pre-dawn gunshots intended to scare brother, police told

Following several gunshots – two inside an apartment at 34th and Kenilworth, then more outside the building—police found and arrested Juan Frausto, 23, of the 3700 block of Wesley, who initially fled the scene in his Pontiac Grand Am.
Witnesses stated Juan fired multiple shots at his 28-year-old brother Norberto Frausto, using a large silver-colored gun. Nobody was injured, but police saw two large holes in the apartment ceiling, and found a shell casing nearby.
Based on the reports of witnesses and a statement signed by Juan Frausto, events unfolded as follows: Juan, Norberto and a man witnesses called “Ray” had been drinking together at a strip joint. They left in Juan’s car, and “Ray” threw up. Juan stated that Norberto became angry, yelled at Juan and choked him. Juan pulled over on Harlem. Norberto chose to walk back to the apartment he shared with his mom at 34th and Kenilworth. Juan drove home, got his 9MM Taurus handgun, and reached mom’s place ahead of his brother. Witnesses said he “ranted” about shooting Norberto, while he waved the gun in the air and fired two shots indoors. When Norberto could be heard outside, witnesses said Juan ran outside, fired three more times, then fled.
According to Juan, he fired shots merely to “scare” his brother. He insisted repeatedly that “if I wanted to shoot him I would have because I’m a good shot and I go to the range all the time.”
Juan Frausto was charge with aggravated unlawful use of a weapon and three counts of reckless discharge of a firearm.
