Guns, ammo, pitbull found after call of shots fired
May 4, 2007, 11:44 PM
Two men told police conflicting tales in the wake of a 911 call about shots being fired near 19th and Clarence. A 28-year-old man said he was in his apartment—where he lives with his girlfriend and two children—drinking beer and doing Tequila shots with a 20-year-old fellow tenant. He said the 20-year-old neighbor showed him two guns: a 9mm and a Colt .45. They “played” with the guns for almost an hour, then the younger man went to the porch and shot the guns. The host said he got scared and told the guest to leave.
Police then spoke with the younger man. His version was as follows(not verbatim): The older guy was drunk, so I drove to a bar to buy Corona and tequila, then returned to his place to drink. I had two beers and two shots. The older guy showed me two guns and pointed them at me. I told him not to do that. He said don’t be scared, the safety is on. He then said “let’s go outside and shoot these m-----f-----s!” I said, no the cops will come, neighbors will call. But he pointed a gun at my head so we went out to the back porch. He handed me a gun and told me to shoot across the alley at a building. I said, no, there may be children, so instead I shot twice in the air. Then he took a gun in each hand and shot both at once. At last the older guy told me to get the f--- out of here, the police will come. So I went down to my apartment.”
When police searched the older man’s apartment, they found a cage in the living room containing a large pitbull. The man’s girlfriend told police the guns were sitting on top of a curio cabinet in the living room. Police secured two guns and several boxes of ammunition from the top of that cabinet. In addition, three spent casings were found by police on the rear steps and landing. The 28-year-old host was charged with aggravated discharge of a firearm; reckless discharge of a firearm; three counts of unlawful use of a weapon; and three counts unlawful use of a weapon by a felon. This guest was charged with the same stuff minus the felony part.
