An officer patrolling an area that has suffered a lot of recent graffiti and burglaries saw a green Ford van drive past 27th and Cuyler for the second time in 10 minutes; its brake lights were always on, even while the van accelerated away from a stop sign. The officer was about to stop the van at 27th and Cuyler when the front seat passenger got out and walked away southbound. The van went east on 27th, south on Highland, and west on 29th. Next, the officer saw the passenger who left the van walking west on 28th, so he got out of the squad car and asked the man if he could talk to him. The officer asked 18-year-old Mark A. Mercado, of the 6300 block of 28th, to remove his hands from his jacket, upon which Mercado moved as if to run. Mercado stopped when he saw a second police car. Mercado called the officer insulting names, also stating “F@&@& you, fat pig, I ain’t done nothing wrong.” The officer told him he only wished to ask what he was doing, to which Mercado responded with more name-calling. When asked his name, Mercado replied, “F@*@ you!” He refused to remove his hands from his jacket; a bulge visible in the jacket led the officer to suspect a weapon, so the officer told Mercado he was about to frisked. Mercado wriggled around to avoid the search. The officer told him to stop resisting and get his hands out where they could be seen. Mercado yelled loudly, “POLICE BRUTALITY! HELP ME, THEY’RE BEATING ME UP!” The officer told him if he did not cooperate he would be handcuffed. Mercado replied, “GOOD! I’M GOING TO SUE ALL YOU M#($*@F@)$ING PIGS!” HE began to kick at the officer and swing his body in an aggressive manner while stating he intended to “kick your a$$!” After another struggle, he was handcuffed and arrested for assault and for resisting an officer.
