Argue the officer out of impounding your car? Not with an expired license, you won’t
September 20, 2008, 4:20 PM
An officer saw a silver Jeep doing 35 MPH in a 20 MPH zone in the 1900 block of East. Driver Pamela Y. Oliver, 46, of the 4700 block of west West End, Chicago, reportedly became very defensive when advised of the reason for the stop, stating “I could not have been going that fast because I just stopped at the stop sign”, then went on to say she was in a hurry to pick up her mom from the hospital. A check of Oliver’s name revealed her license had been suspended on August 6, 2008; when the officer informed her of this, she demanded to know why. The Law Enforcement Agencies Data System (LEADS), however, does not give police that information, only the status of the driver’s license.
Oliver then stated she wanted to pull the Jeep over and lock it. The officer explained that, when a driver with a suspended license is found, the vehicle is automatically towed and impounded; he told Oliver to leave the keys inside, but she refused. Police told her that if she did not leave the key, it would create difficulty for the towing company and extra expense for her, so she complied. During the arrest, Oliver objected to being handcuffed, stating she was not a criminal, but police advised her that the handcuffs were due to department policy to ensure officer safety. Oliver was charged with speeding and driving on a suspended license.
