Freed arm-flapping pot smoker keeps coming back to police department

February 27, 2010, 11:37 PM, February 28, 12:03 AM, 1:00 AM

Police ended up ticketing a man for two joints found in his car ashtray after letting him go earlier in the evening and urging him to seek psychological help. At around 11:30 PM, police saw the 39-year-old man running from a “gang-notorious” corner (26th and Cuyler) and entering a green 1994 Honda Accord. Curbing the car, the officer noticed the strong smell of cannabis wafting from the open window. The driver stepped out of the vehicle as requested and showed a valid drivers license. But when the officer attempted to perform a weapons pat-down, the man would “repeatedly spin around quickly and wave his arms.” The officer handcuffed the man to hold him still, then observed two “small blunt cigars” that appeared to be cannabis in the car’s ashtray. The subject told the officer, he had “smoked them earlier in the day and forgot,” that they were in the car. When a K-9 dog searched the car, the handcuffed subject allegedly told the police, “You know, I could kill that dog if I wanted to.”

The arresting officer noted that he “recognized signs of a mental disorder and let [him] off with a warning and told him to get help” and to get rid of the pot.

At midnight, the man showed up at the Berwyn police station complaining that he was “not happy about being stopped tonight. I did nothing wrong tonight.” An officer explained to him that “he had suspected cannabis in the car and was given a courtesy because of his mental disability.” But the man challenged that interpretation, insisting, “if there is weed in my car, go find it!” He was told that “if there is cannabis and we find it, we’ll give you a ticket.” To which he allegedly responded, “Go ahead!”

The officer walked to the vehicle and “observed the same two-hand-rolled blunt cigars containing suspected cannabis in the vehicle’s ashtray in the exact same location they were observed during the previous traffic stop.” The man was given a $100 ticket for possession of fewer than 2.5 grams of cannabis and left.  However, 50 minutes later, he returned to the police station complaining that someone had left his “paperwork” “messy” in the vehicle. Police inquired if he needed medical assistance and he promptly left the station.
