Accused batterer has woman terrified, but not cops
September 18, 2008, 2:21 AM
Police were sent to MacNeal hospital to speak with a battered woman. The woman, a 34-year-old Elmhurst resident, said she and her boyfriend argued in front of the man’s home in the 2300 block of Gunderson, then the man punched her in the head several times and grabbed her neck. The officer saw the victim had red scratches in her shoulders and neck, as well as dried blood on her hands and fingers.
The victim repeatedly insisted she did not want the boyfriend arrested, and expressed fear that he would find out the police knew of the incident. The officer informed her that, because of her visible injuries, he was signing the complaint for her. At that point, the victim would no longer cooperate.
Police arrested the man at his home. When they arrived, the man stated, “You don’t have a signed complaint and I don’t want to talk to you without a lawyer”. He was, of course, mistaken about the complaint. He was charged with domestic battery.

Carbondale man says beer-toting gangbanger shot at him, can describe but not ID offender
September 17, 2008, 8:50 PM
Dispatchers told police people were screaming in the background during a call reporting “shots fired” at 23rd and Highland. The victim—a 24-year-old Carbondale man—and witnesses at the scene said a man approached the victim and yelled, “What are you?” From this, the victim inferred that a declaration of gang affiliation was requested of him. The victim replied, “Nothing,” to which the offender answered, “Noah, you’re something.” At this, the victim turned and ran away northbound; he said he heard four to five gunshots from behind him. Witnesses said the offender then fled eastbound on 23rd in a white 4-door, possibly Pontiac, car with a black racing stripe down the side and a “spoiler” on the trunk lid. Two other people were in the car, described by witnesses as male Hispanics.
The victim described the man believed to have fired the shots: a male Hispanic, 20-22, 5’8” to 5’9”, medium build, bald, with a goatee, dressed in a white sleeveless T-shirt and blue jeans. The offender, the victim said, approached him holding a beer bottle in his left hand; he kept his right hand inside his pants as if holding a gun. However, the victim insisted he could not identify the shooter or the men in the car, and detectives felt he was very uncooperative. Other witnesses, who were even further away from the offender, told police they could identify him.
Police at the scene recovered a dropped bottle of Bud Light beer and three spent 9MM Luger shell casing.

Stabbed in the Berwyn Hotel
September 6, 2008, 11:16 AM
A man called police from the Berwyn Hotel, 3137 Oak Park, to report he had been stabbed. Police and paramedics found the man seated in a second floor apartment, holding his abdomen, upon which blood was visible.
The victim, a 37-year-old man, said a man in a downstairs apartment stabbed him in the stomach. According to the victim, he had lent a woman in his building $20 and went to her apartment on the first floor to collect it. Inside the apartment, he said, a man walked up to him without a word and stabbed him three times with a sharp object. The victim said he went back upstairs to his apartment to call police. He described the offender as 5’9” and heavy. Witnesses led police to a first floor apartment, where they said a man matching the description lives with his mother.
Police spoke with the woman who reportedly borrowed money from the victim. She said she never saw her son stab the man, but after the victim left the room, she stated, her son said “It’s a good thing I didn’t stab him in the neck.” The woman gave police permission to search their room; officers recovered a black-handled steak knife, which they found under the mattress of a bed the woman said was her son’s.
Doctors told police the victim had a single stab wound to the upper abdomen and would require exploratory surgery.
Police arrested 17-year-old Joseph A. Valerio. After being read his rights, Valerio told police the victim showed up asking for $20, even though his mom only borrowed $5. When the mother handed the victim $5, the victim began to yell, so Valerio said he told him to leave. Valerio said he picked up the knife to scare the victim, and “when I did, the guy lunged towards me and I cut him”.
Valerio was charged with aggravated battery/inflicting great bodily harm, and aggravated battery using a deadly weapon.

Underage drinker at Italian fest exhibits profanity, bad attitude, to police; weapon recovered
August 31, 2008, 10:40 PM
A tipster told police two males at the Italian fest, Harlem and 24th, appeared to be breaking into a red car. When an officer approached, he saw the pair attempt to hide a half-full 750 ML bottle of Silver Patron Tequila. Both were intoxicated and verbally combative. One was Hector J. Ruiz, 18, of the 6700 block of 16th. The second told police he had no ID, but gave his name as Ariel A. Mijangos, 19, of the 2500 block of Elmwood. Mijangos spontaneously stated, “Berwyn police are a bunch of punk-ass n_____s, messin with a n____ just trying to have a good time and drink.” Because he appeared so intoxicated, paramedics were summoned. Mijango continued to be verbally combative and uncooperative. Although the officer told him multiple times to place his hands on the squad car, Mijango pulled away and appeared to be reaching for a weapon, forcing the officer to place him on the ground. The officer recovered a heavy black metal pipe, 10 inches long, after it fell from Mijango’s waist area. The tequila was also recovered. Ruiz was arrested without incident, reportedly saying, “You won’t have anything like that with me. I’ll be cool.”
During the ride to the police station, Mijango continued in the same vein, making several threats to harm the officer and other gang-related comments; he also spit multiple times inside the squad car.
Ruiz was cited on a local ordinance for possession of alcohol by a minor, then released. Mijango was charged with consumption of alcohol by a minor, possession of alcohol by a minor, unlawful use of a weapon, and resisting a peace officer.
